The newest Private Hospitals document is a PRELIMINARY (draft) notification, not in force. The operative rates remain those of the 2018 final notification. That draft is also issued under the Code on Wages, 2019 — the first transition signal on this site away from the repealed Minimum Wages Act, 1948.

A pharmacy inside a hospital is the recurring case. Where the pharmacy is part of the hospital's own operation, the hospital's notification generally governs; a separately constituted pharmacy business is a medical shop. How the pharmacy is constituted — same entity or separate — is usually the deciding fact.

A standalone clinic that is also a commercial establishment is a genuine grey area. The clinical nature of the principal activity is the better indicator, but this is a classification worth documenting rather than assuming, because it is exactly the kind of point an inspector takes.
