Frequently asked questions
What is the ESI wage ceiling?
Coverage applies to employees drawing gross monthly wages up to ₹21,000, or up to ₹25,000 for persons with disability. An employee whose wages exceed the ceiling on the date of joining is outside the scheme.
Who pays what under ESI?
The employee contributes 0.75% of gross wages and the employer contributes 3.25%. The employer share is the larger of the two.
Are contract staff counted for the 10-employee threshold?
Contract workers engaged in or in connection with the work of the establishment are generally counted. Practically, the principal employer should be able to evidence who is on site, under what arrangement, and with what documentation.
What happens if an employee’s wages cross the ceiling mid-year?
If wages exceed the ceiling at the time of joining, the employee is excluded. Once covered, continuation depends on the applicable contribution-period rules rather than a simple month-to-month test, so the position should be checked rather than assumed.
